Preserving New Jersey's General Aviation Airports

On September 21, 2000, Governor Whitman conditionally vetoed Bill A2332. In a letter I received from Governor Whitman, she stated that while she supports this bill and believes that preserving the long-term viability of public-use airports throughout the state is necessary for the maintenance of a safe and efficient air transportation system. In addition, increasing development pressure threatens the future of many such facilities that are absolutely essential to our aviation infrastructure, she had recommended some important changes. These changes included 1) defining the term "unrestricted public use airport" as an aviation term that does not modify or infringe upon existing municipal zoning or land use authority, 2) requiring the Department of Transportation to obtain two independent appraisals of the development rights to be purchased and 3) to provide notice and a public hearing on the proposal at a site convenient to the affected municipalities.
Governor Whitman also reduced the annual funding from $5 million to $2.5 million from the General Fund.
The Bill went back to the legislature for modifications on October 5, 2000 and was passed by both houses. It is now NJ State law.
